However, I am also critical because the court did not attempt to define the intensity of reckless behavior that qualifies as a misdemeanor. There is also a need, first, to redefine the scope and meaning of the term reckless domestic violence because the current state of affairs exposes the Supreme Court decision to manipulation. I am thinking of incidences where a spouse in a hideous manner position in situations that would bring harm through the unintentional and non-malicious conduct of their partners. I think the Supreme Court should treat every condition with merit, for it sets precedence. Negligence is not an excuse under law, but it should not attract similar infringement of rights like intentional conduct. History has shown that cruel and inhumane punishment is counterproductive in the justice system.
